Purchases

Forms of Payment

The artist accepts payments in US dollars via Stripe and Square (which can process major credit cards and bank transfers) or cash if the Buyer is local to Portland, Oregon.

Payment must be made in full within 14 days of invoicing. Artwork invoices after this period will be canceled, and the work(s) will be considered available for offer to others. For services, unpaid invoices are subject to late fees 60 days from the due date.

Layaway payments are unavailable at this time.

Online shop purchases

The artist regularly lists a small selection of available works through an eCommerce website (shop) hosted by Square. The website accepts payment by all major credit cards and Afterpay. Other merchandise is purchased through print-on-demand vendors; the artist is not responsible for items other than original artworks and limited edition items purchased through the Square shop.

If the Buyer would like to purchase an artwork listed in the Artist’s Shop in a different way or purchase a work not listed, contact the Artist via email (please note that artworks are unique and limited in quantity, and availability is not guaranteed).

Resale

The buyer shall only resell artwork purchased from the artist once it has been paid for and collected, delivered, or shipped to the Buyer or the Buyer's common carrier. If the Buyer decides to sell a work purchased from the Artist within three (3) years of the date of purchase, the Buyer agrees that the artwork will be offered back to the Artist at fair market value. The artist reserves the right of refusal.

State of Washington Tax Notice

For Buyers living in Washington, please be aware that sales or use tax is due on certain purchases delivered or sourced to Washington. Washington requires you to file a use tax return when sales tax is not paid at the time of purchase. This message is required under the Revised Code of Washington 82.13.020(2)(a)(i).

Commissions

The artist accepts commission requests on a case-by-case basis. The artist’s ability to offer commissions is subject to change based on factors within and outside of the Artist’s control.

Before work can begin, the buyer must make a down payment of 50% of the purchase price. This includes one round of review and feedback during the concept phase. Subsequent rounds of review and feedback are subject to a $50 fee per session. If the project does not continue past the concept and feedback phase, the Artist keeps the fees and down payment. Commissioned artwork can not be returned or refunded for any reason. Upon completion of the project, the Buyer must remit payment in full before artwork delivery.

The artist retains full Copyright and moral rights of all images, sketches, concept work, and finished pieces unless a written agreement is otherwise made and signed by all parties, with fair financial compensation to the Artist for the surrender of such rights.

Shipping, Pickup, Delivery, Returns

Shipping is at the Buyer’s expense unless otherwise noted by the Artist. Shipping, packing, and delivery costs cannot be reimbursed.

If the Buyer is located in Portland, Oregon, local delivery or pick up at the artist’s studio in Southeast Portland can be arranged. Delivery does not include entering private residences. The artist may offer installation services starting at $150/hour with a one-hour minimum; services must be agreed upon and scheduled in advance.

International shipping is limited and requires a custom shipping quote. The Buyer is responsible for duties and customs fees when shipping internationally.

For the Shop, by-weight shipping and handling fees are provided during checkout. If the Buyer would like a custom shipping quote (sans customs duties and fees, if international), contact the Artist via email with the artwork selection and shipping address.

All sales are final on original and limited edition items and artwork.

TERMS OF SERVICE

The artist may revise these terms of use for this website (Site) without notice. By using this Site, you (the User) agree to be bound by the current version of these Terms of Service. If you do not agree with any of these terms, do not use or access this Site.

The artist will not be held liable for misusing this Site or any site linked to it by people not authorized to make purchases, download files, or perform any other type of action. The User of this site is responsible for being aware of and abiding by laws according to their geographical location or jurisdiction.

The materials in this Site are protected by applicable intellectual property law, including copyright and moral rights. Any claim relating to Artist's Site shall be governed by the laws of the State of Oregon without regard to its conflict of law provisions. Unless otherwise noted, all texts and images presented on this Site are © the Artist.

Squarespace hosts site content, Square hosts the shop, and MailChimp hosts and manages email lists.

PRIVACY POLICY

Artist highly values your privacy and will always treat your information with the utmost respect. Cookies and site traffic data are collected anonymously and in aggregate to monitor how users interact with this site.

All personal information provided when making a purchase or subscribing to the Artist's mailing list is confidential and will not be shared with a third party unless explicit permission is obtained for a specific purpose.

Artist uses MailChimp to manage and send announcements to subscribers on the studio mailing list. Please get in touch with the artist by email if you have questions or want to be removed from the mailing list. The artist cannot access credit card numbers for goods purchased through the Shop or entered by Buyers through digital invoicing. Only the credit card processing company can access this information to complete the checkout process. Payments are processed via Square, and Stripe. Buyers may request to make card payments via one of those providers at their discretion, as described in the Purchase Policy above.
